ClanFit Terms of Use

1. Who we are

ClanFit (“we”, “us”) provides a connected fitness platform for gym owners, trainers, and members. Contact:

2. Agreement

By creating an account, downloading the app, or using ClanFit, you agree to these terms. If you use ClanFit for a gym, you also confirm you are authorised to bind that gym. If you do not agree, do not use the service.

The iOS app is licensed, not sold. Your license to the iOS app is subject to these terms and to Apple’s standard EULA linked above. Apple is not a party to any agreement between you and ClanFit for gym operations, member records, or gym membership billing.

3. The service

ClanFit lets gyms run memberships, attendance, staff, workouts, nutrition, community, and related operations. Roles (owner, trainer, member, and other staff) see only what that gym’s access model allows. We may change, suspend, or discontinue features with notice where the law requires it.

ClanFit is not medical advice, a clinical record, or a substitute for a licensed professional. Gym access-control hardware, biometric devices, and independent gym websites are operated by the gym or its vendors, not by ClanFit, except as described in the privacy policy.

4. Accounts

You must provide accurate contact details and keep OTP and login credentials confidential. You are responsible for activity under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close accounts that violate these terms, abuse the product, or create security or legal risk.

You can delete your account in the app (Profile → delete account) or by emailing team@joinclanfit.com. Deletion and retention are described in the privacy policy. Gym invoices and attendance the facility needs for its books may remain archived.

5. Two kinds of paid plans

Do not mix these up:

ClanFit gym SaaS (Premium Plan). This is the auto-renewable subscription the gym pays so the gym can use ClanFit. On iOS it is sold through the App Store. On Android it is sold through Razorpay where enabled.
Gym memberships sold to members. Plans, freeze, extend, and front-desk collections are contracts between the member and that gym. ClanFit records those transactions for the gym. Refunds, access, and freeze rules for a gym membership are decided by the gym, not by ClanFit, Apple, or Google.

6. Auto-renewable ClanFit subscriptions (App Store)

If you subscribe to ClanFit’s Premium Plan on iOS, payment is charged to your Apple ID at confirmation of purchase. The title, length, and price shown in the app and on the App Store product page are the offer you accept.

Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours before the current period ends, at the then-current price for that plan.
You can manage or cancel auto-renew in Apple ID settings: Settings → [your name] → Subscriptions, or at apps.apple.com/account/subscriptions.
If a free trial or introductory price is offered, unused time is forfeited when you buy a subscription, where Apple’s rules allow it.
Apple is the merchant of record for App Store purchases. Refund requests for those charges go through Apple.

We unlock gym SaaS features after Apple confirms a valid purchase or restore. Restoring purchases uses your Apple ID. Sharing an Apple ID subscription across unrelated gyms in a way that circumvents the plan is not allowed.

7. ClanFit subscriptions on Android

Where gym SaaS is billed through Razorpay, Razorpay is the payment processor. Recurring charges follow the Razorpay mandate and the plan you selected in the app. Cancel from the in-app subscription screen or by contacting us. Card and UPI details are handled by Razorpay, not stored as PAN in ClanFit.

8. Play Store purchases

If you buy through Google Play, Google is the merchant of record for that transaction. Manage or cancel Play subscriptions in the Google Play subscriptions settings. Refund questions for those charges go through Google.

9. Acceptable use

You may not:

Probe, disrupt, or overload the service, or access another gym’s data without authorisation.
Upload unlawful, infringing, or harmful content, including member data you are not allowed to process.
Misrepresent your gym, identity, or a payment.
Reverse engineer the apps except where the law says you may.
Use ClanFit to send spam or unsolicited marketing outside the gym’s operational messages.

Gyms are responsible for the lawfulness of member records they enter, including age, identity documents, and biometric enrolment on gym hardware.

10. Intellectual property

ClanFit, the apps, the website, and related marks are owned by us or our licensors. You keep ownership of content you or your gym upload (member photos, workout plans, catalogues). You grant us a licence to host and display that content only to operate the product for your gym. You must have the rights to upload it.

11. Availability and support

We aim for reliable uptime but do not guarantee uninterrupted service. Maintenance, network issues, App Store or Play outages, and third-party processors (OTP, maps, payments, push, WhatsApp) can affect features. Support: joinclanfit.com/support.html, team@joinclanfit.com, or +91 76248 65656.

12. Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Workout, diet, BMI, and attendance tools are operational aids, not medical devices.

13. Liability

To the extent the law allows, ClanFit is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for gym-floor incidents, denied access at a biometric door, or a gym’s own billing dispute with a member. Our total liability for a claim about the service is limited to the amounts you paid us for ClanFit gym SaaS in the 12 months before the claim, or INR 5,000 if you paid us nothing, except where the law forbids that cap (including liability for fraud or personal injury caused by our negligence).

Nothing in these terms limits rights you have as a consumer that cannot be waived, including rights under Indian law and, for App Store purchases, rights you have against Apple under Apple’s terms.

14. Indemnity

If you operate a gym on ClanFit, you will defend and indemnify us against claims arising from your member data, your gym’s access-control hardware, your marketing, or your breach of these terms, except to the extent caused by our wilful misconduct.

15. Apple-required licence terms (iOS)

For the iOS app, the following applies in addition to Apple’s standard EULA:

The licence is limited, non-exclusive, and non-transferable, for use on Apple-branded products that you own or control, as permitted by the App Store terms.
Apple has no obligation to provide maintenance or support for ClanFit. We, not Apple, are responsible for addressing claims relating to the app, including product-liability, legal, and consumer-protection claims, to the extent these terms and the law require.
If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the app’s purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Apple is a third-party beneficiary of these EULA terms. Upon your acceptance, Apple has the right to enforce this EULA against you as a third-party beneficiary.

16. Governing law

These terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India have exclusive jurisdiction, except that you may have mandatory consumer-forum rights in your place of residence, and App Store billing disputes follow Apple’s process.

17. Changes

We may update these terms. We will change the date above and, for material changes, notify you in the app or by email where required. Continued use after the effective date means you accept the updated terms, unless the law requires a fresh agreement. If you do not agree, stop using ClanFit and cancel any auto-renewing subscription through Apple, Google, or Razorpay as applicable.
